semble n. [French: it seems] Used to suggest that a particular point may be doubtful. A good example of this can be found in the case of Hedley Byrne v Heller & Partners [1963] 2 All ER 575 (HL) 576 E-F. Here Lords Reid, Morris, and Hodson establish a proposition concerning a bank’s provision of the creditworthiness of a client to another party. In such instances, they state, there is no legal duty on the bank beyond that of giving an honest answer. This is the belief of their lordships. They could, of course, be wrong in law. This is a matter to be tested in future cases concerning the same point. |
