withdrawal of issue from jury
A procedure enabling a judge, who is satisfied that there is insufficient evidence to discharge the evidential burden of proof borne by a party, to discharge the jury and enter judgment for the opponent if the issue is decisive of the litigation. If the issue is not decisive of the litigation as a whole, he may direct the jury to find against that party in respect of that issue. |
