statutory legacy Under the Administration of Estates Act 1925 s 46, the legacy (officially known as the fixed net sum) to which a surviving spouse (or civil partner) is entitled on an intestacy. Where the intestate leaves a surviving spouse and children, the spouse receives a legacy of £270,000 (from 6 February 2020, increased from £250,000) before the division of residue between the spouse and the children. For deaths prior to 1 October 2014 where there are no children but surviving parents or brothers or sisters, the surviving spouse received a legacy of £450,000 before the residue was divided between the spouse and those other relatives. For deaths on or after 1 October 2014, the £450,000 statutory legacy has been abolished and the surviving spouse or civil partner receives the whole of the residuary estate with nothing passing to other relatives. |
