n. In civil proceedings, a claim brought by a defendant in response to the claimant’s claim, which is included in the same proceedings as the claimant’s claim. A counterclaim asserts an independent cause of action but is not also a defence to the claim made in the action by the claimant. It is an example of a Part 20 claim. See also set-off.
