reference n. 1. The referral by a court of a case (or an issue arising in a case) to another court or an arbitrator (referee) for a decision or opinion. In the High Court any action or any question or issue of fact arising from it may be referred to an official referee for trial. In the county courts, a case may be referred to the district judge for an opinion and report. Under the Treaty of Rome, a court may refer to the European Court of Justice a question of Community law for a preliminary ruling and must do so if it is a court from which there is no appeal within the national system. 2.
