European Arrest Warrant
(EAW) An arrest warrant designed to strengthen cooperation between the national jurisdictions of the member states of the EU by eliminating the use of extradition. Based on a Framework Decision adopted in June 2002, these warrants have been issued since January 2004.

With the departure of the UK from the EU and the end of the Brexit implementation period, the UK left the EAW framework. However, the European Union (Future Relationship) Act 2020 contained provisions for the surrender of citizens between the EU and the UK that are in practice very similar to the previous arrangements; the main differences are a new emphasis on proportionality and the removal of the European Court of Justice as the court of last instance. The government’s Extradition (Provisional Arrest) Act 2020 (Schedule A1) also included all 27 member states of the EU in a list of “trusted countries” whose requests for extradition would normally be granted without a UK arrest warrant being necessary.
