declaration concerning public or general rights A declaration made by a person concerning the reputed existence of a public or general right. Public rights affect everyone (e.g. a public right of way) while general rights affect a class of people (e.g. a right of common). An oral or written declaration concerning public or general rights has traditionally been admissible at common law as an exception to the hearsay rule, for example when the maker of the declaration has since died. |
