European Works Council
(EWC) In multinational companies within the European Economic Area (EEA), a council consisting of both employee and management representatives established at European level to inform and consult with employees on transnational issues. The requirement to set up such councils originated from the European Works Council Directive 1994, later revised by Directive 2009/38. The directives apply to undertakings or groups with at least 1,000 employees across member states of the EEA and at least 150 employees in each of two or more of those member states. In the UK, the 1994 Directive was implemented through the Transnational Information and Consultation of Employees Regulations 1999, and the amended Directive by the Transnational Information and Consultation of Employees (Amendment) Regulations 2010, which took effect in 2011. The Regulations set out procedures for negotiating an EWC agreement, enforcement mechanisms, and statutory protections for employees who are members of such a group when asserting their rights or performing duties under the Regulations. With the UK’s exit from the EU, the Regulations will continue to apply to those EWCs that were established before 1 January 2021. However, the base for such an EWC will need to be relocated to another EEA state. Those sections of the UK Regulations that provided for the establishment of new EWCs have been deleted.
