[Latin: favour of the contract] The maxim that a contract should be upheld wherever possible and that there should be a general presumption against setting it aside for some purely formal reason or because some part of it is invalid or unclear. The principle is also important in public international law, that is to say, a treaty should not be allowed to expire for reasons that are purely formal or procedural. |
