flexible working The Employment Act 2002 and associated regulations provide that employees who have completed 26 weeks’ continuous employment have the right to request (by application) that their employer make a change in their working hours and conditions, including the option of working from home (Flexible Working (Eligibility, Complaints and Remedies) Regulations 2002; Flexible Working (Procedural Requirements) Regulations 2002 (as amended)). Employers have a duty to consider these requests seriously, but there is no automatic right to work flexibly. The employee must apply in writing and may make only one application a year. The employer must meet the employee to discuss the application within 28 days of the request; within 14 days of the meeting the employer must either agree to the request or explain why it was refused. There is an appeal procedure. If the employer accepts the application, terms and conditions are changed permanently unless the parties agree otherwise. |
