Gillick-competence In medical law, the status of a child under 16 who has sufficient maturity and understanding to consent to a particular medical treatment. Once a child is deemed by a medical professional to be Gillick-competent, he can be treated without the consent or knowledge of his parents. The refusal to have treatment by a Gillick-competent child can, however, be overridden by the courts, by his parents, or by someone with parental responsibility. The term refers to the decision in the case Gillick v West Norfolk and Wisbech Area Health Authority [1985] 3 All ER 402 (HL). |
