agricultural holding A tenancy of agricultural land under the Agricultural Holdings Act 1986. Tenants have special statutory protection and there is a procedure to fix rent by arbitration if the parties cannot agree. The 1986 Act gives the tenant security of tenure, and the landlord normally has to give at least one year’s notice to quit. At the end of the tenancy, the tenant can claim compensation for disturbance and for improvements he has made; similarly, the landlord is entitled to compensation if the holding has deteriorated and the tenant is at fault. No new Agricultural Holdings Act tenancies may be created after 1 September 1995 (see farm business tenancy). Tenancies and licences to those working the land may give security of tenure under the Housing Act 1988 if the tenants are qualifying workers (working on the land as defined in the Act) and otherwise qualify.
