right to marry A right set out in Article 12 of the European Convention on Human Rights and now part of UK law as a consequence of the Human Rights Act. The right is not a particularly strong one; it only exists subject to the national laws governing the exercise of this right. However, the courts have imposed some restrictions on those laws in that barring transsexuals from marrying was ruled a violation (Goodwin v UK (2002) (App no 28957/95) 35 EHRR 447; Bellinger v Bellinger [2003] UKHL 21). This right to marry does not apply to lesbians or gay men (Chapin and Charpentier v France (2016) ECHR 504) but there is a right to some form of legal recognition for such unions (Oliari and others v Italy App nos 18766/11, 36030/11) ECtHR, 21 July 2015). |
