good behaviour
A term used in an order by a magistrate (Justice of the Peace Act 1361; Magistrates’ Courts Act 1980) or by a Crown Court (Justices of the Peace Act 1968 s 1) upon sentencing. The person named in the order should “be of good behaviour” towards another person (e.g. the victim). The court may order that the person named enter into a recognizance, and if he does not comply with the order he may be imprisoned for up to six months. The procedure may be used against anyone who has been brought before the court if there is a fear that he may cause a breach of the peace or if he is the subject of a complaint by someone (which need not be based on the commission of a criminal offence).
