honest opinion A statutory defence in defamation. The defendant must show that the statement complained of was a statement of opinion (not of fact), that it indicates the basis of the opinion, and that this opinion could have been held by an honest person. The defence is defeated if the claimant can show that the defendant did not actually hold the opinion. Under the Defamation Act 2013 the defence of honest opinion replaced that of fair comment. |
