The prohibition on inhuman treatment or punishment as set out in Article 3 of the European Convention on Human Rights is part of UK law as a consequence of the Human Rights Act 1998. This right is an absolute right. Public authorities have a limited but positive duty to protect this right from interference by third parties. The authorities also have a duty to investigate effectively and independently any credible allegation of such ill treatment. |
