innuendo n. In an action for defamation, a statement in which the words may be defamatory as a result of a hidden meaning. The hidden meaning must be capable of being understood from the words themselves by people to whom the statement is published. A true innuendo is one in which the meaning is hidden in the absence of special facts and circumstances: in this situation the claimant must set out in his particulars of claim the facts or circumstances that make the words defamatory (Tolley v J S Fry & Sons Ltd [1931] AC 333 (HL)). A false innuendo is one that an ordinary person, guided by his general knowledge and experience, would infer from the natural and ordinary meaning of the words (Lewis v Daily Telegraph Ltd [1964] AC 234 (HL)): in this situation the claimant does not have to support his claim with additional evidence. |
