in personam [Latin: against the person] Describing a court action or a claim made against a specific person or a right affecting a particular person (compare in rem). A court’s jurisdiction in personam is its authority to exercise its power over an individual and to see that its decision is enforced. The maxim of equity “equity acts in personam” refers to the fact that the Court of Chancery issued its decrees against the defendant himself, who was liable to imprisonment if he did not enforce them. |
