Miller’s case (No. 1) The case R (on the application of Miller and another) v Secretary of State for Exiting the European Union [2017] UKSC 5, in which the Supreme Court held that an Act of Parliament was required to authorize ministers to give notice of the decision of the UK to withdraw from the European Union (see Article 50). The court thus rejected the government’s argument that, following the result of the Referendum on Continued Membership of the European Union, it had power under the royal prerogative to begin the process of withdrawal without a parliamentary vote. To meet the requirement of the Supreme Court, the government brought forward the European Union (Notification of Withdrawal) Act 2017, which received royal assent on 16 March 2017; notice of the UK’s intention to withdraw was served on the EU on 29 March.
