notice of discontinuance In civil proceedings, a notice served by a claimant under Part 38 of the Civil Procedure Rules voluntarily giving up all or part of a claim. In general, a claimant may discontinue all or part of a claim at any time by filing a notice of discontinuance with the court and serving copies on the other parties. Where there is more than one defendant, the claimant may discontinue all or part of a claim against all or any of the defendants. The permission of the court may be required if the claimant wishes to discontinue a claim where an interim injunction has been granted; where the claimant has received an interim payment; or where there is more than one claimant. |
