uberrimae fidei
[Latin: of the utmost good faith] Describing a class of contracts in which one party has a preliminary duty to disclose material facts relevant to the subject matter to the other party. Non-disclosure makes the contract voidable (see voidable contract). Examples of this class are insurance contracts, in which knowledge of many material facts is confined to the party seeking insurance. |
