peaceful enjoyment of possessions A right set out in Article 1 of the First Protocol to the European Convention on Human Rights and now part of UK law as a consequence of the Human Rights Act 1998. This right is a qualified right; as such, the public interest can justify an interference with property by a public authority providing that this is prescribed by law, designed for a legitimate purpose, and proportionate. Generally, public authorities that deprive people of their possessions will need to pay compensation in order for their actions to be justified. |
