serious harm Under section 1 of the Defamation Act 2013, a statement is not defamatory unless its publication has caused or is likely to cause “serious harm” to the reputation of the claimant. For the purposes of this section, harm to the reputation of a body that trades for profit is not serious harm unless it has caused or is likely to cause the body serious financial loss. In Cooke v MGN [2014] EWHC 2831(QB), [2014] WLR(D) 379 the High Court gave its first guidance as to what would otherwise constitute serious harm. Justice Bean said that “serious harm” indicates that a higher threshold of reputational harm is required than under the previous law, under which the threshold was that the statement “substantially affects in an adverse manner the attitude of other people towards claimant”.
