service out of the jurisdiction Service of a claim form, petition, or application notice outside England and Wales. The rules concerning service out of the jurisdiction, obtaining permission of the court to serve out of the jurisdiction, and the procedure for serving out of the jurisdiction are set out in Part 6 of the Civil Procedure Rules. Under the Civil Jurisdiction and Judgments Act 1982 and the Judgments Regulation, service out of the jurisdiction on a defendant domiciled in a Regulation State does not need permission of the court. In other cases permission of the court may be granted if the grounds specified in the Civil Procedure Rules are satisfied. In general, some particular connection must be shown between the defendant or the subject matter of the proceedings and the jurisdiction of the English courts. |
