Sexual Harm Prevention Order
A civil order that replaced the Sexual Offences Prevention Order in 2015. A Sexual Harm Prevention Order can be made only where the court thinks it necessary for the purpose of protecting the public or any particular members of the public from “serious sexual harm” from an offender, but can be drafted in any way the court sees fit to achieve this purpose. The order can be made by the magistrates’ court or Crown Court at the point of sentence or by complaint to a magistrates’ court in respect of someone previously convicted of a sexual offence, where that person’s behaviour suggests the possibility of reoffending. The penalty for breaching an order is up to five years’ imprisonment. The order can be for a fixed period but of not less than five years.
