sub nomine (sub nom) [Latin: under the name] A phrase used in law reports when the name of the case has changed through the process of appeal. For example, before the House of Lords we have the case of R v Shaw [1961] 1 All ER 330, in which Frederick Shaw was found guilty on three counts by the Central Criminal Court. Leave to appeal was granted by the Court of Criminal Appeal in respect of counts 1 and 2. Owing to the public policy issues involved in these counts, the case for the Crown was brought by the Director of Public Prosecutions. The case was then entitled Shaw v DPP [1961] 2 All ER 446. Thus, the House of Lords report will state in its details of the appeal process: “Shaw v DPP reported sub nom R v Shaw [1961] 1 All ER 330”. |
