special procedure orders
A form of delegated legislation consisting of orders made by government ministers under powers that are expressed in the enabling statute to be exercisable by order subject to special parliamentary procedure. The Statutory Orders (Special Procedure) Act 1945 applies to such legislation. This requires that the order be laid before Parliament together with a certificate by the minister responsible specifying that all the requirements of the enabling Act have been fulfilled. Petitions for its annulment or amendment may be presented. Special procedure orders, which have largely replaced provisional orders, are used primarily to confer powers on local authorities. The compulsory purchase of land must also in certain cases (e.g. land owned by local authorities or the National Trust) be effected by a special procedure order. |
