释义 | 私人檢控 A prosecution (including proceedings on indictment) commenced by a private person. The right of a member of the community to institute and prosecute an offence has long been regarded as one of the bastions of the common law system: Ex p Crawshay (1860) 24 JP 805. The right to prosecute in proceedings before a magistrate is expressly recognised by statute: Magistrates Ordinance (Cap 227) s 14. A court may stay proceedings initiated by a private prosecutor on the basis that they are an abuse of the process of the court: R v Bow Street Stipendiary Magistrate, ex p South Coast Shipping Co Ltd [1993] QB 645, 1 All ER 219. The Secretary for Justice is entitled to take over and continue, or discontinue, a private prosecution: Magistrates Ordinance (Cap 227) s 14.
