unpaid seller A seller of goods who has not been paid in full for them or who has received a cheque or other negotiable instrument that has not been honoured. Although ownership of the goods may have passed to the buyer, an unpaid seller has certain rights against the goods themselves. Under the Sale of Goods Act 1979, these rights are: (1) a possessory lien (particular, not general); (2) a right of in transitu">stoppage in transitu; and (3) a right of resale. |
