beneficiary principle The principle that, for a trust to be valid, there must be a human beneficiary capable of enforcing the trust (Morice v Bishop of Durham [1805] EWHC (Ch) J80). Exceptions to the beneficiary principle are charitable trusts and a limited number of purpose trusts that are commonly referred to as “trusts of imperfect obligation”. It has been held that indirect human beneficiaries satisfy the beneficiary principle (Re Denley’s Trust Deed [1969] 1 Ch 373). |
