voluntary settlement
A settlement made without valuable consideration. Most trusts are voluntary because neither the trustees nor the beneficiaries give consideration for the settlement, and such trusts remain unenforceable until they have been fully constituted (see constitution of trusts); the maxims of equity “equity will not assist a volunteer” and “equity will not perfect an imperfect gift” apply. |
