cessate grant 1. A grant (e.g. of a lease) renewing a previous grant that has lapsed. 2. A second grant of representation issued when the first grant was conditional or limited in some way and the condition or limitation has either been fulfilled or the original grantee has died leaving it unfulfilled. It is usually required when the estate of the deceased has not been fully administered but unlike a grant de bonis non administratis it operates as a re-grant of the whole estate rather than the unadministered part. For example, where letters of administration are issued to a person for the use and benefit of a minor named as executor, a cessate grant is required when the minor reaches 18. See grant for the use and benefit. |
