material and essential validity of a will
In private international law, a rule determining which country’s laws govern the validity of gifts under a will where, for example, the testator had a foreign domicile or owned foreign assets. Under English law a gift is valid in relation to moveable property if it complies with the law of the domicile of the testator, and in relation to immoveable property if it complies with the law of the country in which the property is situate (lex loci situs).
