child subjected to physical abuse A child subjected to any form of intentional physical harm, as by hitting, kicking, shaking, burning, etc., by a parent, step-parent, or any other person with whom he or she is living. Such a child may be protected if the other parent (or person who is looking after him or her) applies for a non-molestation order under the Family Law Act 1996, but only if the child is living, or might reasonably be expected to live, with the applicant. A child may also apply for a non-molestation order with permission from the court. When a child is suffering, or likely to suffer, significant harm, a local authority may apply for a supervision order, care order, or emergency protection order under the Children Act 1989. Where the threshold criteria are met, these orders are also available for children suffering non-physical (e.g. emotional or psychological) forms of abuse. See also child cruelty; neglect. |
