Convention right Any right protected under the European Convention on Human Rights that is included in the Human Rights Act 1998. When an issue arises in a case in relation to a Convention right it is said to be “engaged”. The Human Rights Act applies across the whole of the United Kingdom, but in addition Convention rights are protected in Northern Ireland, Scotland, and Wales by the legislation (1998) setting up the devolved bodies in those countries. The provisions ensure that any action taken by these bodies is unlawful if it violates any Convention right (Northern Ireland Act, Scotland Act, Government of Wales Act). This protection is more far-reaching than the Human Rights Act, in that it allows the courts to disapply legislation or rules made by the devolved bodies. |
