domestic violence protection notice (DVPN) A notice issued by a police officer (the “authorizing officer”) containing provision to prohibit a person (P) from molesting the person for whose protection it is issued. The aim is to provide immediate protection for the victims of domestic violence where there is not enough evidence to bring an immediate charge. Under the Crime and Security Act 2010, the notice may be issued if P is 18 or over and the authorizing officer has reasonable grounds for believing that P has used or threatened violence towards an “associated person” (see non-molestation order) and that the notice is necessary to protect that person from the violence or the threat. While the officer must take into account inter alia the interests of a “relevant child” and the opinion of the associated person, the notice can be issued without the consent of the person it is designed to protect. The notice may regulate the use of any premises in which the associated person lives. P may be arrested where a constable has reasonable grounds for believing that P has breached the notice. The issuing of a DVPN triggers a duty for a constable to apply for a domestic violence protection order (DVPO), and the application must be heard by a magistrates’ court within 48 hours of its service, or within 24 hours of any arrest for breach. The order, which imposes the same protective measures as the notice, lasts for a minimum of 14 and a maximum of 28 days. |
