employer’s liability
The liability of an employer for breach of his duty to provide for his employees competent fellow-workers, safe equipment, a safe place of work, and a safe system of work, including adequate supervision (Wilson and Clyde Coal Co Ltd v English [1938] AC 57 (HL) 141). This includes a duty not to cause psychiatric injury (Barber v Somerset CC [2004] UKHL 13, [2004] 1 WLR 1089; Hartman v South Essex Mental Health and Community Care NHS Trust [2005] EWCA Civ 6, [2005] ICR 782). Liability can be in tort for damages for negligence and for breach of statutory duty under statutes providing for safety at work; there are also criminal penalties.
