Financial Conduct Authority
(FCA) A body corporate set up under the Financial Services Act 2012 as one of two successor bodies to the Financial Services Authority (FSA), the other being the Prudential Regulation Authority (PRA). Its purpose is to regulate the provision of financial services and markets. The Financial Services and Markets Act 2000, which established the FSA, contains a general prohibition against any person carrying out any regulated activity unless that person is authorized or exempt. Regulated activities include investment advice, stockbroking, deposit taking, and more general consumer transactions involving the provision of mortgages, insurance, and basic banking services. It is an offence, unless exempt, to carry on a regulated activity without authorization. Those in contravention may be unable to enforce transactions and investors who suffer loss may be entitled to compensation. The FCA has powers of investigation in respect of financial crime (e.g. insider dealing), handling the proceeds of crime, and market abuse. Among other powers, the FCA can conduct investigations into breaches of the general prohibition and into the nature of the business or the ownership or control of an authorized person.
