damages-based agreement (DBA) A form of no win, no fee agreement in which a claimant’s lawyers are paid a percentage of any damages that are recovered. Until April 2013 DBAs were permitted only in employment tribunal cases; however, the Damages-Based Agreements Regulations 2013 extend this type of agreement to civil litigation. The lawyer can claim up to 25% of damages (excluding damages for future care and loss) in personal injury cases; 35% of damages in employment tribunal cases; and 50% of damages in all other cases.
