judicial separation order An order by the courts that spouses (or civil partners) do not have to cohabit, but that stops short of terminating the marriage (or civil partnership). Now that such obligations are rarely enforced, an application for judicial (or legal) separation is appropriate when there are religious objections to divorce, or the parties have not finally decided upon divorce but there is a desire to access financial remedies, etc. The courts have largely the same powers in relation to financial orders and children as they do when granting a divorce. In line with the reforms of the Divorce, Dissolution and Separation Act 2020, no particular facts need be cited in any application for a judicial separation beyond a desire by one or both parties for a separation. |
