restriction order An order placing special restrictions (for a specified period or without limit of time) on the discharge from hospital of a person detained there by a hospital order. It may be made by the Crown Court (but not a magistrates’ court) when this appears necessary for the public protection, and its principal effects are that discharge may be authorized only by the Home Secretary and may be subject to conditions (e.g. subsequent supervision by a mental welfare officer). A restriction order is made under section 41 of the Mental Health Act 1983. |
