paternity leave After the birth of a child an employee who has or expects to have, responsibility for bringing up the child, and who is the father of the child or the mother’s husband or partner, may take either one or two consecutive weeks’ paternity leave. The employee must have worked for the employer for 26 weeks ending with the 15th week before the child is due or the adoption placement is made. The leave may only commence when the child is born or the placement begins. During paternity leave, most employees are entitled to statutory paternity pay (SPP), which is currently (as of 6 April 2021) £151.97 per week or 90% of the employee’s average salary (whichever is the lower). This is paid by employers for either one or two consecutive weeks, as the employee has chosen. Employees must inform their employers of their intention to take paternity leave by the end of the 15th week before the baby is expected, (or the placement is expected to commence), unless this is not reasonably practicable. They must tell their employer when the baby is due (or the child will be placed), how much leave they want, and when they want it to start. Employees are entitled to return to the same job after paternity leave and are protected from suffering unfair treatment or dismissal for taking, or seeking to take, such leave. Fathers may also claim additional paternity leave by taking some of the leave to which the mother would have been entitled but did not take. If the mother is not entitled to maternity rights, additional paternity rights do not apply. If the mother has taken at least 20 weeks maternity leave and has returned to work, the father may claim up to 26 weeks paternity leave. During the leave the father is entitled to be paid at the same rate as statutory maternity pay (SMP), but the payment period cannot extend beyond the 39 weeks of the mother’s entitlement to SMP (Shared Parental Leave Regulations 2015). This payment is known as shared parental pay (ShPP). Both the leave entitlement and the payment remain the same where a child is adopted. See also adoption leave; dependants’ leave; parental leave. |
