positive discrimination Actively favouring one category of people over others because they are considered to be disadvantaged and thereby discriminating against those others. Positive discrimination is illegal in the UK (although it is not unlawful to treat disabled people more favourably than non-disabled people). “Positive action” is, however, permitted. This may involve measures designed to alleviate disadvantage experienced by people who share a “protected characteristic” (see 2010">Equality Act 2010), to reduce under-representation within the workforce, and to meet particular needs. An example might be training, if targeted to particular groups. Such measures must be a proportionate way of achieving the relevant aim. In relation to recruitment and promotion at work, the Equality Act 2010 allows (but does not require) an employer to select recruits or candidates from under-represented groups, where they are equally well qualified as the other candidates. |
