pre-sentence report
A report, normally prepared by a probation officer or youth offending team worker, made with a view to assisting a criminal court to determine the most suitable method of dealing with an offender. It is based on interviews with the offender. The report considers the offence itself, the culpability of the offender, and the offender’s circumstances, as well as the risk of the offender re-offending and of harm to the public. It also gives the probation officer’s opinion on the suitability of particular kinds of sentence, such as a community sentence. Under the Criminal Justice Act 2003 a court will normally order a pre-sentence report before imposing a sentence of imprisonment or making a community order with requirements. In straightforward cases, a report can be prepared on the day of sentencing and delivered orally to the court. This is often referred to by practitioners as a stand down report.
