directions questionnaire Under the latest Civil Procedure Rules, a questionnaire that is served on both parties after the defendant has filed a defence; its purpose is to assist the court in allocating the case to the most appropriate track (see allocation). As such, it replaces the allocation questionnaire for all cases in which a defence is received on or after 1 April 2013. There are now two separate questionnaires: one for cases that the court has provisionally allocated to the small claims track; and one for cases that may be allocated to either the fast track or the multi-track. Failure to return a completed questionnaire and any accompanying documents by the date specified may result in the claim (or the defence) being struck out. |
