technology transfer
The licensing of intellectual property. EU regulation 316/2014 (previously 772/2004) provides block exemption from Article 101 (EU competition law) for certain categories of patent, software copyright, and know-how licence (and also for trade mark, design, copyright, and other intellectual property licences that are ancillary to such a licence). The regulation also sets out those restrictions that are void and anti-competitive and must be avoided in such licences. These provisions are mirrored in the UK Competition Act 1998, which is part of retained EU law. |
