quia timet [Latin: because he fears] An injunction granted for the purpose of quieting a present apprehension of a probable future injury to property. In order to succeed in a quia timet action, the claimant must prove imminent danger of a substantial kind or that the apprehended injury, if it does come, will be irreparable (Colls v Home and Colonial Stores [1904] AC 179 (HL)). |
