real evidence
Evidence in the form of material objects (e.g. weapons). When an object is admitted in evidence, it is usually marked as an exhibit. Documents are not usually classified as real evidence, but may be treated as such if the physical characteristics of the document (rather than its content) are of significance. Some authorities include evidence of identification and the demeanour of witnesses within the classification of real evidence. Photographs, video, and sound recordings may be treated as real evidence or as documentary evidence (Taylor v Chief Constable of Cheshire [1986] 1 WLR 1479). |
