survival of cause of action on death
At common law all causes of action in personal actions (i.e. contract and tort) died with the person in whom they were vested (actio personalis moritur cum persona). By statute, however, all such causes of actions, except for defamation and claims for certain types of loss, survive against or for the benefit of the deceased. See also fatal accidents. |
