释义 | 合併罪名 A procedure authorised by statute by which two or more charges are joined together in the same information or indictment so that they are tried jointly at the one time: Criminal Procedure Ordinance (Cap 221) s 18. Each charge is a separate charge and the magistrate, judge or jury must give a separate verdict in respect of each charge: R v Ng Kam Wah [1993] 1 HKCLR 163 (CA). The joinder of charges is permitted where those charges are founded on the same facts, or form or are a part of a series of offences of the same or a similar character: Indictment Rules (Cap 221C) r 7. This rule is subject to the discretion of the trial judge to order severance on the basis that the accused may be prejudiced in his trial: R v Kray & Ors [1969] 3 All ER 491, 53 Cr App Re 569, [1970] 1 QB 125. One of the tests the court should look to see whether the alleged offences were linked by a sufficiently close nexus: Ludlow v Metropolitan Police Cmr [1970] 1 All ER 567, [1971] AC 29 (HL).
